The lawsuit charges these firms with knowingly causing ongoing pollution from per- and polyfluoroalkyl substances (PFAS) in New York via their consumer products and neglecting to alert the public about the related risks.

James is seeking a court order to hold these corporations responsible for damage to the environment and public health and to require financial contributions for cleanup initiatives in New York State. The lawsuit also demands compensation, restitution, and financial penalties, in addition to requiring companies to properly inform consumers about the dangers of PFAS-containing products.

Attorney General James remarked that companies like 3M and DuPont have marketed hazardous products that imperiled the health of New Yorkers and contaminated the environment for many years, stressing that it is now time for these companies to address the harm inflicted.

At the same time, the US Environmental Protection Agency (EPA) has chosen to ease federal regulations concerning PFAS in sewage sludge fertilizer or ‘biosolids.’ When these biosolids are applied to agricultural land, PFAS can be taken up by crops or ingested by livestock, resulting in bioaccumulation within the food chain. In late June, the EPA set aside an earlier evaluation made under President Joe Biden, which pointed to considerable health risks from PFAS-laden biosolids. Instead, the guidance released during the Trump administration provided voluntary suggestions for reducing PFAS risks tied to land-applied biosolids.

These developments are situated within a larger context characterized by an active criminal investigation into PFAS-contaminated biosolid fertilizers that reportedly harmed farmers and killed livestock in a Texas county years prior. The supplier of the fertilizer conducted its own laboratory tests, asserting that these findings cleared it of liability.

Moreover, a lawsuit brought against the EPA by Texas farmers, ranchers, and environmental organizations, seeking to urge the agency to regulate PFAS in biosolids, was dismissed in September 2025, though an appeal remains in progress.

These incidents highlight the difficulties and intricacies involved in tackling PFAS pollution, with legal, environmental, and health factors intertwined in ongoing efforts to control and alleviate its effects.

New York State Attorney General Letitia James has filed a lawsuit against major American chemical corporations, including 3M, Chemours, and DuPont, on July 9th.
