The US Department of Homeland Security (DHS) has released a final rule instituting a four-year limit on visas for international students and researchers holding F-1 student and J-1 exchange visitor statuses. This alteration affects programs such as chemistry and other research PhDs, which usually require five years to finish in the US. Students may have to leave the US to obtain an extension, leading to considerable expenses. Higher education organizations are contesting these new stipulations, set to begin on 15 September.<\/p>\n<p>In the past, students and researchers with these visas were granted entry for the length of their academic program. According to the new regulation, they are required to either apply for an extension with the DHS or depart and re-enter the US. This travel may result in added costs, although some graduate labor unions provide support funds that might cover qualifying costs.<\/p>\n<p>The DHS asserts that the rule aims to curb abuse and fraud, referencing data that indicates more than 2100 foreigners who arrived as F-1 students from 2000 to 2010 remain in active status as of 2025. However, this number constitutes just 0.067% of the approximately 3.1 million individuals who entered the US on F-1 visas during that period.<\/p>\n<p>A transition phase will permit current students to remain in the US while they wait for extension approval. Nevertheless, the policy has elicited over 20,000 public comments expressing apprehensions. Detractors, including Nafsa and the Presidents&#8217; Alliance on Higher Education and Immigration, maintain that it introduces unnecessary bureaucracy and uncertainty, undermines academic decision-making, and discourages international students, potentially damaging the US economy and global standing.<\/p>\n<p>Given that the median time to complete a PhD in the US is 5.6 years, the four-year cap presents considerable difficulties for PhD candidates.
